Terms of Service

1. Acceptance of Terms

By installing, accessing, or using GovCon Tracker (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not install or use the Service. You must be at least 18 years of age to use GovCon Tracker.

2. Service Description

GovCon Tracker is a Google Sheets™ add-on that provides access to publicly available government contracting data from SAM.gov, including contract opportunities, entity profiles, award history, exclusion records, teaming partner discovery, and registration health monitoring.

The Service includes:

14-Day Free Trial: Full access to all features at no cost during the trial period
Pro Subscription ($49/month): Continued full access to all 6 modules, 9 custom formulas, and 6 sheet templates after the trial period

3. Account Registration

GovCon Tracker requires a Google account for installation and use. Your Google account email is used solely for license verification. You are responsible for maintaining the security of your Google account. Report any suspected unauthorized access to nealm682@gmail.com.

4. License Grant

Subject to these Terms and payment of applicable subscription fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use GovCon Tracker for your internal business purposes. This license does not permit you to:

Copy, modify, or distribute the Service or its underlying code
Reverse engineer, decompile, or disassemble any part of the Service
Resell, sublicense, or offer the Service as a service bureau to third parties
Use the Service for any unlawful purpose or in violation of any applicable law
Automate bulk data extraction beyond the intended use of the provided formulas and sidebar

5. Subscriptions and Billing

After the 14-day free trial, continued use of GovCon Tracker requires a paid subscription at $49/month, billed through the Google Workspace™ Marketplace. Subscriptions auto-renew monthly unless cancelled.

Billing is handled entirely by Google. We do not store your payment information.
Subscriptions may be cancelled at any time through your Google Workspace™ account. Cancellation takes effect at the end of the current billing period.
No partial refunds are issued for unused portions of a billing period.
We reserve the right to change pricing with 30 days' notice to active subscribers.

6. Acceptable Use

You agree not to use GovCon Tracker to:

Violate any applicable local, state, federal, or international law or regulation
Transmit any harmful, offensive, or disruptive content
Attempt to gain unauthorized access to our systems or SAM.gov's systems
Interfere with or disrupt the integrity or performance of the Service
Scrape, harvest, or systematically extract data beyond what the Service is designed to provide
Impersonate any person or entity

7. Data and SAM.gov

All government contracting data displayed by GovCon Tracker is sourced from SAM.gov, a public database operated by the U.S. General Services Administration. This data is publicly available and subject to SAM.gov's own terms of use. GovCon Tracker is not affiliated with, endorsed by, or sponsored by SAM.gov, the GSA, or any U.S. government agency.

Data accuracy is subject to the timeliness of SAM.gov's own updates. We make no warranties regarding the completeness, accuracy, or currency of SAM.gov data displayed through the Service.

8. No Legal or Compliance Advice

Nothing in GovCon Tracker constitutes legal, compliance, procurement, or business advice. All data is provided for informational purposes only. You are solely responsible for your own contracting decisions, bid/no-bid determinations, and compliance with applicable procurement regulations.

9. Intellectual Property

GovCon Tracker, including its code, design, branding, and documentation, is owned by us and protected by applicable intellectual property laws. SAM.gov data displayed through the Service is U.S. government public domain data.

Any feedback or suggestions you provide may be used by us to improve the Service without obligation or compensation to you.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SAM.GOV DATA WILL BE ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless GovCon Tracker and its operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

You may stop using the Service and uninstall the add-on at any time. We may suspend or terminate your access for any reason, including violation of these Terms, with or without notice. Upon termination, your license to use the Service ends immediately.

14. Changes to Terms

We may update these Terms at any time. Changes will be posted to this page with an updated effective date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, at our election.
